Superlegalizácia
V prípade, že ste sa dostali do situácie, že potrebujete použiť oficiálny dokument v krajine, ktorá nie je zmluvnou stranou Dohovoru o zrušení požiadavky vyššieho overenia zahraničných verejných listín z 5. októbra 1961 (tzv. Haagský dohovor), tak Vám nebude stačiť apostil, ale budete musieť použiť superlegalizáciu.
Čo je superlegalizácia?
Superlegalizácia je vyššie overenie a osvedčenie verejných listín, ktoré sa majú použiť pred orgánom cudzieho štátu. Verejnou listinou je listina, na ktorej je odtlačok pečiatky slovenského orgánu/úradu alebo úradnej osoby a podpis úradnej osoby. Vyšším overením sa neoveruje obsah alebo pravdivosť obsahu verejnej listiny, znaleckého posudku či prekladu.
Superlegalizácia je potrebná vo všetkých krajinách, ktoré nie sú zmluvnou stranou Dohovoru.
Na rozdiel od apostilácie si superlegalizácia vyžaduje dve osvedčenia. Superlegalizácia je teda náročnejšia ako apostilácia. Prvé osvedčenie zvyčajne vykoná jeden alebo dva vnútroštátne štatne orgnány – napr. súd alebo ministerstvo. V niektorých štátoch je osvedčenie zverené viacerým štatnym orgánom, napr. ministerstvo škostve pre diplomy a vysvedčenia a krajské súdy pre osvedčenie podpisov notármi apod. Existujú však aj štáty kde je osvedčenie zverené iba jedinému štátnemu orgánu, napr. v Spojenom kráľovstve. Druhé osvedčenie dokumentu vykoná ambasáda štátu určenia.
